UAE Labour Laws & Gratuity

Gratuity entitlements under your employment contract
Labor law in the UAE comprises details that are not commonly seen elsewhere. The labor law UAE is stringent and rigidly enforced. Apart from the general labor law that applies to most of the UAE, there are exceptions, such as special labor related regulations that apply to some free zones in the UAE.
Types of Employees and Staff the Law Applies To
In accordance with Article 3 of the UAE labour law 2014, those employed in the UAE (UAE nationals and expatriates) are all termed employees. There are however, certain categories of employees who are exempted from Article 3. These include:
  • Federal government staff and workers, government departments of the member emirates, municipalities, public bodies, federal and local public institutions, and all those staff and workers employed in federal and local governmental projects.
  • Members of the armed forces, police and security units.
  • Domestic servants.
  • Agricultural workers and all those engaged in grazing
(Note: 1. this does not encompass those employed in corporations that process agricultural products and/or; 2. those who are permanently engaged in operating or repairing of machines used for agriculture).
